TED Picture Your LifetimeTM Release Form

I hereby grant to TED conference (“TED”) and Preclick Corporation. (“Preclick”) and each of their assigns, a perpetual worldwide non-exclusive license and right to publish, copy, modify, display, and distribute all images taken of me or by me and contained in Photograph(s) taken at the TED 2003 Conference, in whole or in part, in any print, electronic or digital media or software, including publication at the TED.com and Preclick.com websites.

I represent and warrant that, for any photographs taken by me and personally uploaded or otherwise submitted by me, (a) I am the sole creator of said Photograph(s); (b) the Photograph(s) is/are original; (c) reproduction, publication or distribution of the Photograph(s) will not infringe upon or misappropriate the proprietary rights of any third party; and (d) the Photograph does not defame any person or unlawfully invade their privacy or violate their rights of publicity.

I further grant TED and Preclick to publish and otherwise use my name, photograph and/or likeness and to identify me in conjunction with any said publication of the Photograph(s), including but not limited to, as author, or subject, of the Photograph(s).

I hereby release and discharge TED and Preclick, their employees, agents, licensees, successors and assigns, harmless from any and all claims, demands or causes of actions that I may have or may hereafter have for libel, defamation, invasion of privacy or right of publicity, infringement of copyright or trademark, or violation of any other right arising out of or relating to the use and exercise of any rights granted herein. I further release and discharge TED and Preclick from and against any and all claims, damages, liabilities, costs and expenses arising out of a breach of any of the foregoing warranties.

Nothing herein shall be construed to obligate TED and/or Preclick to produce, distribute or use any of the rights granted herein.

The terms of this release shall be construed according to the laws of the State of California applicable to all agreements which are executed and fully performed within said State.

The Preclick Privacy Policy

Preclick Corporation is a software company that enables a user to efficiently and effectively manage,organize, share and professionally print digital pictures. Preclick communicates information regarding its products and services through Preclick.com, a public marketing site for users of its Photo Organizer software. Photo also includes a client software component that resides on the PC hard drives of users.

Preclick is committed to striving to meet or exceed fair information practices related to information provided through our Web site and product. Users wish to know about the data collection practices of businesses and technologies that interact with their computer when they visit the Internet. This Privacy Policy describes Preclick’s business, technology, and policies on privacy and data protection.

To permit users of Preclick.com to control the use of their data, users have the choice not to have online information collected about them through use of cookies. See below regarding cookies and opting out. As part of Preclick's marketing, sales and customer service activities on the Internet, users may be requested to provide personal information, including, but not limited to, name, company name, email address, title, country, phone number, and information regarding potential use of the Preclick Photo Organizer software and any problems they may be currently experiencing. This information, where posted, is used to distribute marketing materials based on requests for information on products and services; and to provide support related to problems and questions regarding the Preclick Photo Organizer software. Additionally, if you have given Preclick permission, Preclick may use your contact information to provide information about products and services from Preclick.

Preclick maintains internal practices to protect the security and confidentiality of private data by limiting employee access to and use of this information, and by implementing technological and systemic firewalls. Preclick uses generally accepted standards of technology security in order to protect information from loss, misuse, alteration or destruction. Only authorized personnel and agents are provided access to personal information and certain databases containing non-personal information, and these employees have agreed to ensure confidentiality of this information.

Preclick does not gather or retain information about a user's individual health condition, detailed financial information, sexual orientation or behavior, information that appears to relate to children under 13, racial and ethnic origin, political opinions, religious or philosophical opinions or beliefs, and trade union membership or information about visits to other Internet sites, even though that information may be linked only to a cookie and not to personal information, such as a user's name or address. Preclick does not knowingly collect or maintain personal information about anyone under the age of 13.

Preclick may disclose information to persons providing services that assist Preclick in its business provided those persons agree to use the data according to the same polices and principles. These include companies participating in our Photo Organizer software program. This Privacy Policy also covers information distributed through the Preclicksoftware,including email addresses of Photo Organizer software users.

Preclick may collect non-personally identifiable information about usage of the software. The information collected will be used in aggregate to improve the performance of the service and to improve the software based on the requirements of the user base. Additionally, Preclick may use your contact information to provide information and news about products and services from Preclick. You can opt out of these mailings by sending your email address to support@preclick.com.

Thefollowing Privacy Statement covers Preclick software, as well as activities on Preclick.com:

  1. Preclick will not use a user's name, address, email address, or phone number to deliver Internet ads or to solicit the purchase of goods or services from third parties (non-partners). In the event of a merger, acquisition or liquidation, Preclick may disclose personally identifiable information to the other parties in the transaction.
  2. Preclick encourages its partners to engage in fair information practices and to disclose their relationship with Preclick. Preclick also asks its partners to link from their Privacy Policy to this Privacy Policy to allow customers to opt-out of the Preclick cookies.
  3. Preclick may change its Privacy Policy at any time, but personal information will be treated in a manner consistent with the policy under which it was collected unless Preclick has the individual's consent to use it differently.
